This Whiskey bottle is no longer a VIP Product

Back in November 2022 we reported on proceedings between Whiskey maker Jack Daniels and squeaky dog toy maker, VIP Products over a squeaky dog toy in the shape of a Whiskey bottle and read “Old No.2 on Your Tennessee Carpet”. The matter was to be heard before the Supreme Court in March this year. This week the Supreme Court has returned a unanimous ruling in favour of Jack Daniels, in its decision, the court claimed Jack Daniel’s trade marks had been infringed and its products had been associated with “dog excrement”. Chief legal officer of the Distilled Spirits Council of the United States, Courtney Armour claimed the victory for Jack Daniels shows that consumer confusion should not be circumvented just because something is arguably funny. The ruling shows the importance of registering a trade mark and how registered rights can help protect your brand.
