A tattoo artist has successfully sued leading game publisher Take-Two Interactive Software, Inc (“Take-Two”). WWE wrestler Randy Orton’s tattoo artist, Catherine Alexander, issued proceedings against Take-Two back in 2018 on the grounds it used five of her ink designs without permission. All designs in question are tattooed on Randy Orton. Catherine Alexander created the fives designs, which consisted of a tribal tattoo, skulls, a bible verse, a dove and a rose, between 2003 and 2008. The artist claimed the art was “easily recognised by [Orton’s] fans and members of the public”. She further claimed WWE offered to pay her £395.00 ($450.00) to use a design in its merchandise, an offer which Alexander turned down. Alexander claims she did not grant WWE “permission to copy, duplicate or otherwise use or reproduce” any of the designs. A jury awarded Alexander £3,300.00 ($3,750.00) in damages. This isn’t the first time Take-Two have been subject to such infringement. In 2016, a tattoo artist unsuccessfully sued the company for using basketball star LeBron James’ tattoos without permission. It is to be seen if Take-Two have learnt from the litigation.
