Nike have recently secured a resounding victory before the Taiwan Intellectual Property Office following its opposition to a registration for a trade mark that would have been “confusingly similar to earlier marks” (as per Taiwan’s Trademark Act).
This follows Nike’s strong approach to protecting its intellectual property rights globally, which has been a factor in it developing into the multi-billion pound company it is. However, there has been some speculation as to whether it is fair that the fame attached to Nike’s trade marks enables it to enjoy greater protection for its intellectual property rights. Nike’s scale also allows it to enjoy the benefit of monitoring filings globally, further cementing its international reach.
