Back in September 2022, we reported on the allegations of copyright infringement faced Ed Sheeran. Sheeran stands accused by the heirs of Marvin Gaye of copying the late singer’s song “Let’s Get It On” with his 2014 single “Thinking Out Loud”. The claim was originally filed in 2017 and has finally appeared at Manhattan Federal Court to testify against the allegations. Jury selection and opening statements took place today, with the trial expected to last a week. Judge Louis L. Stanton will hear the parties’ submissions. It is expected that the jurors will be required to evaluate elements of the melody, harmony and rhythm components of “Let’s Get It On” as documented on sheet music filed with the USPTO. Sheeran’s representatives contend that the similarities between the two pieces arise simply from their use of foundational elements of popular music. Sheeran argues “the two songs share versions of a similar and unprotectable chord progression that was freely available to all songwriters”. Submission from both parties will be heard in the week to come. Following his victory in the UK High Court last year, it remains to be seen if Ed Sheeran will enjoy the same success in the US when the current trial concludes.
