Podcasts have become a huge phenomenon that have swept the digital market in recent years. Whilst filled with opportunity, podcasts also harbour an array of risk. That is all too familiar for the original co-hosts of the hit podcast “Sex, Lies & DM Slides”, Gizzi Erskine and Sydney Lima. The co-hosts claim they have been ousted from their own podcast by Spotify. It is alleged Spotify rebranded the podcast and replaced the creators with influencers Anastasia Kingsnorth and Saffron Barker. Erskine argued that Spotify stole the name and format of the podcast and failed to provide notice to the co-hosts. On 21 July 2022, Spotify filed two trade mark applications, one at the UK Intellectual Property Office and one at the US Patent and Trademark Office for the mark “Sex, Lies & DM Slides”. Both applications have been accepted and registered by the respective Offices. No objections to the marks were received, but the matter highlights the risk to content creators and the need to protect intellectual property rights.
