American hard rock band Guns N’ Roses have issued proceedings against a gun shop in Texas for alleged trade mark infringement. The shop in Texas is trading under the name “Texas Guns N’ Roses” and this, claims the band, infringes upon the bands trade mark. In documents filed with the court, the band claims the use of the mark by the shop is likely to cause confusion and is likely to deceive purchasers into thinking the shop is affiliated, connected, or associated with the band. The shop sells firearms and metal gun safes, which, argues the band, is even more damaging as the band does not want to be associated with a firearms and weapons retailer. The band is seeking the shop to change its name and to pay a sum of damages. The shop is allegedly planning on fighting the claim.
