As part of an ongoing dispute between our client Mrs Mariya Lish (as Claimant and Appellant) and The Northern Block Limited (“TNB”) and Mr Jonathan Hill (as Defendants and Respondents), McDaniels Law are delighted to have recently advised and represented Mrs Lish to a favourable decision in the Court of Appeal following a hearing on 15 April 2026.
The bench, made up for Coulson LJ, Arnold, LJ and Moylan LJ, determined that the largest element of Mrs Lish’s appeal, in respect of a finding that her claim for unpaid royalties was abusive and which had been struck out at first instance, should succeed and that this claim was not abusive. We are delighted to have obtained this result for our longstanding client. Her claim will now proceed to a full trial on the issue of unpaid royalties and in respect of a breach of Part 36 terms on a previous case (this aspect of the first instance decision was not subject to appeal).
