Famous US hip-hop duo, Outkast, recently issued proceedings against Californian rapper and producer, Ovrkast, in the federal court in Atlanta, Georgia, for alleged trade mark infringement, unfair competition, and breach of contract. Outkast accuse Ovrkast of deliberately using a confusingly similar stage name with the aim of riding on the coattails of their fame.
Outkast’s holding company, High Schoolers LLC, which owns several US registered trade marks for the word ‘OUTKAST’ and the duo’s crown and crest logo, filed evidence demonstrating that Ovrkast’s use of his stage name has already caused actual confusion amongst consumers. Notably, this evidence includes an interview given by Ovrkast to Rolling Stone in 2025, wherein he states that listeners had confused him and his music as being a “mimic” of Outkast, or even as being Outkast themselves.
Outkast also allege that Ovrkast has breached a settlement agreement relating to the dispute, with the latter purportedly having agreed to rebrand his persona, websites, and merchandise to the name ‘Overkxst’ by 15 July 2026. Since Ovrkast continued to use that stage name, failed to adopt the supposedly agreed alternative moniker, and is instead allegedly still pushing for alternatives previously rejected by Outkast, High Schoolers LLC also accuses Ovrkast of continuing to use his stage name in the knowledge that it infringes various registered trade marks. Outkast therefore seek an injunction to prevent Ovrkast from continuing to use the name, costs, and damages.
Since Outkast supposedly sought to resolve the matter amicably in the first instance, and may have achieved a settlement but for Ovrkast’s last-minute renege, the Atlanta court may not look favourably upon Ovrkast’s conduct. However, whether the parties may yet still find a resolution before proceedings progress further remains to be seen.
