Following Cole Palmer’s trade mark applications for “COLD PALMER” and his iconic ‘shivering’ celebration, French vineyard Château Palmer has filed an opposition. This follows Palmer’s inclusion of ‘wines’ in his trade mark specification.
Palmer’s legal team has already dealt with another potential opposition from Champagne Palmer & Co., who have negotiated a limitation for Palmer’s mark. Champagne Palmer & Co. have commented to deny any further involvement in the matter, and only time will tell how Palmer’s legal team respond to the opposition set out by Château Palmer
The abovementioned oppositions demonstrate that it is crucial to ensure that trade mark applications relate to the goods and services the applicant intends to offer in order to avoid potential oppositions.
