Last year we reported on a Norwich based gin maker, Bullards, applying to register its name as a trade mark at the UK Intellectual Property Office (“UKIPO”). Global energy drinks firm Red Bull opposed the mark for inclusion of the term “bull”. Red Bull claimed the mark would cause confusion amongst consumers for containing the word “bull”. Red Bull requested Bullards withdraw its application under certain goods, including, non-alcoholic beverages such as energy drinks. However, Bullards refused to back down and have since succeeded in the opposition proceedings with Red Bull. The UKIPO ruled in favour of Bullards, rejecting Red Bulls argument that Bullards had chosen the name to take advantage of Red Bulls reputation. Red Bull have until 22 November to appeal the decision.
