American firm Headwater Research LLC (“Headwater”) has issued separate patent infringement claims in two Texas federal courts against parties including Apple Inc., Amazon, Google and Comcast. Headwater’s claims are based upon patents owned by it for mobile devices and their functionalities, such as the method by which notifications are delivered.
Headwater has already been successful in a number other claims this year, including a victory against Samsung and out-of-court settlements with Verizon, AT&T and T-Mobile – amassing over $400 million (approx. £295 million) in total damages.
Time will tell as to whether Headwater will be successful in its most recently filed claims, or achieve further sizeable settlements, but Headwater has enjoyed significant success thus far. The large sums at play in respect of damages in these matters (even without accounting for legal costs on top), demonstrate just how vital it is that you seek the appropriate legal protection for your inventions and products and obtain specialist legal advice where necessary.
