American pharmaceutical and biotechnology company Moderna, Inc, (“Moderna”) has issued proceedings against rival Pfizer and its German partner BioNTech (“the Partnership”) for patent infringement. Moderna and Pfizer were both front runners in the race to find a suitable vaccine which protected against COVID-19. Moderna issued the claim in a US district court in Massachusetts and in the regional court of Dusseldorf in Germany. Moderna allege Pfizer copied technology that Moderna had developed years before the pandemic. A representative for Moderna claimed the company have invested billions of dollars in creating the technology prior to the pandemic and the lawsuit is aimed at protecting the technology, not stopping people from getting vaccinated. This is not the first lawsuit on the radar of the Partnership. The companies are subject to multiple infringement allegations from companies claiming the Partnership’s vaccines infringe on their patents. It is to be seen which way this case will sway.
