The Trade Mark’s Bond. James Bond.

A Dubai-based property developer has issue proceedings in the UK and EU seeking to invalidate a number of James Bond related trade marks on the basis of non-use. The marks in question relate to the merchandising of goods and services under the James Bond name.

Danjaq LLC and Eon Productions Limited, the joint owners of the marks, have enlisted a European law firm to file over 200 pages of evidence proving these marks have been in use. Such evidence includes collaborations with the world’s oldest hatters, Lock & Co, who have released officially licensed apparel featured in the James Bond franchise. Furthermore, luxury lifestyle brand Bogner have provided information on their goods in relation to the marks.

While it seems unlikely that the James Bond trade marks will be revoked on the basis of this third-party trade mark action, this matter serves as a reminder to use your trade marks in respect of the goods and services for which they are registered, and to keep a record of that use.
