Small fashion company, House of Zana have been successful in a legal battle with Zara.
Back in April we reported on Darlington based House of Zana, who, after attempting to trade mark the name of the business, received a trade mark opposition from popular global fashion giant Zara. Representatives for Zara claimed the brands are “conceptually identical” and urged House of Zana to rename and rebrand.
The court sided with Ms Kotrri, who represented herself at the hearing, claiming there are differences between the marks and therefore the likelihood of confusion on the part of the consumer was low.
This news will come as a relief to other smaller independent businesses and smaller designers who may find themselves feeling threatened by large, corporate companies.
