In June 2020, BrewDog, the famous brewery and pub chain which was formed in 2007 applied to register “Tiger Strike” as a trade mark at the UKIPO. BrewDog’s application saw Jeffrey Lawrence, the owner of Shropshire Gin Company, oppose the application in October 2020. Lawrence alleged that the applied for mark would lead to confusion between BrewDog’s range of spirits and Shropshire Gin Company’s range. In his opposition, Lawrence claimed the applied for mark was visually, aurally and conceptually similar to his own mark Tiger Vodka.
The UKIPO has now ruled in favour of Lawrence and the Shropshire Gin Company, stating that BrewDog’s goods are identical to the goods of Shropshire Gin Company under its mark Tiger Vodka and the UKIPO has found the marks to be visually, aurally and conceptually similar to a medium degree.
BrewDog has since stated that it has already made its decision to not move forward with the launch of Tiger Strike and therefore this decision by the UKIPO has not impacted the future plans of the company.
