Additionally, Kelly comments that "it is very unfortunate when these things happen but with the right advice, businesses can protect and enforce their rights successfully. Doing so is a deterrent for any would-be future infringers and also allows the infringed party to take advantage of the publicity of a successful result which, although difficult to quantify, undoubtedly has a very high value".
